TITLE: PEOPLE’S HOMESITE & HOUSING CORPORATION vs. HON. ERICTA (Dispositive portion) FACTS: People’s Homesite & Housing Corporation – Petitioner Hon. Vicente Ericta, the acting branch clerk of the court and Jaime O. Rivera Respondents In 1971, the Court ordered People’s Homesite and Housing Corporation to execute a Deed of Sale in favor of the petitioner, Jaime O. Rivera –who is a ed tenant of the land, is awarded to purchase the property in its original cost. The past rentals are to be considered partial payment of the purchase price. PHHC filed a motion for reconsideration in 1975, arguing that the dispositive portion of the order did not include the purchase price of the property. The PHHC contends that only the dispositive portion of the decision constitutes the real judgment which should be executed. ISSUE: Whether or not the reconsideration requested by the petitioner, PHHC must be allowed. HELD: NO. The court dismisses PHHC’s request for reconsideration for lack of legal basis. The court grants that the respondent judge’s decision is final and executory, thus the petitioner PHHC must execute the sale of the property in favor of the private respondent, Rivera. The Court does not wholly subscribe to the view that the judgment can be found only in the dispositive portion of the decision.
